Based on, not only the murder, but the circumstantial evidence found, he's proven to us that he's a danger to society. IMO, we shouldn't think of this whole dilemma as solely a punishment for his actions, but more about keeping him at bay so that people are kept out of harms way. Whether it's bail or immunity, same shit - it's too much of a risk to even consider setting him free, such as the possibilities you mentioned of what he might do. If he's free, who knows if he'll drug binge again, and/or possibly lead to another murder? It ain't worth it IMO. And it's also a fucking joke that he's even allowed back into the sport if he is to be set free.

Keeping him imprisoned indefinitely, will make matters more flexible. Because from there, prosecutors can then decide whether or not they'll lay extra charges on him, and/or give him treatment such as psychological help. Who knows? Getting help could possibly make him a better person in the future. But first things first, he needs to be convinced to perceive that by being imprisoned, he's doing the whole world a favour (ie. keeping everyone safe), rather than just a punishment for his actions. "Sorry sir, it was an 'accident'. I won't do it again, I promise". That just doesn't cut it for me. And I'm not saying that my opinion is the best one, it's just that we need to consider all options here.

what speaks for Oscar is:

No crime record.
Showed a lot of regret in court. Has been crying like a sprinkler system
Got family with parents, brother, sister that can act as support
that the trial can be over a year away

what speaks against is

the severity of the charge
potential flight risk
that the judge has already said he will get no special treatment just because he's famous/crippled

The magistrate seems to have been very contradictory here. Saying that he regards it as a schedule 6 offence and that the defence had not proved there was a case for exceptional circumstances, and then grants bail. Now, if he's said the defence have not proved these exceptional circumstances, how has he reached this conclusion?

If you ask me he got special treatment. But that's to be expected.

Granting bail was probably the right call. He's not a flight risk imo and there is no risk he can tamper with evidence and that he commits other crimes is a minimal risk too considering his empty crime record.

So that's a lesson: If someone beats you up, fires his gun at accident in a restaurant or whatever: Please press charges or years later that guy gonna look "almost" clean in court. Oscar was lucky he had no violent history, at least on paper

Undoubtedly. How many remand prisoners families are able to visit them whenever they please? I should imagine we'd be able to count them on less than one finger...And as I said earlier, had this been Joe Soap from Soweto, I'd doubt very much whether the magistrate would've been (a) taking two hours to decide upon his bail application and (b) working so hard to justify his decision on the applicant's behalf.

Very harsh terms for the bail (or are they just normal? I am not that familiar with the law). Nevertheless, he won't have it all peachy:

- He must surrender his firearms.

- He must not drink alcohol or use prohibited substances.
