One good thing about Andy is he's very truthful and thoughtful in his interviews

it's still supporting him.

Many people said that the supervisor's decision was good but didn't agree with the way people like you made it sound like something "criminal", that it was not an accident, and all that bullshit.

Besides, on the first thread about Nalby's act, I saw other reactions by players meaning "hey it can happen, do not overreact" (I remember Karlovic joked about it for instance)

Totally agree with Murray there. That on-court interview should have never happened.

I have never called what he did "criminal", that's for the police to decide. I called it an "assault" because that's exactly what it was.

OK I didn't use the correct word but anyway not an accident or something just deserving being defaulted and losing ranking points, as many other people said

... including some players who supported Nalbandian against the many people who spoke like you.

I respect this man. Much more class than the Spanish (other than Versaco who defended Nalby).

Wise words from Murray, seeing things in perspective. Ofcourse he is familiar with not controlling his temper at times, so he can see this in a realistic way.

Anyone saying "I'd never do this or that" has obviously never heard of Stanley Milgram.

I'm flabbergasted at some of the views on this. I hope none of you are ever assaulted to then find the police say 'he/she didn't mean it and we're not going to do anything'.

Anyway, as I said in another thread you get the society and behaviour you accept/defend, so good luck all because after each terrible action is tolerated it gets worse!

As for Murray: I agree, he should have been taken off the court IMMEDIATELY. Not to protect him but to strip him of his prize money, slap him with a 12 month ban, and a police escort to the nearest station. I've seen Murray jogging before in Marylebone: I wonder if he would wish to have me 'protected' if I did what Nalbandian did?

Andy is a very honest guy. One of the great things about him.

However, Nalbandian is an idiot for what he did and he always will be known as an idiot.

Not surprising that he'd be chased by the police with uptight pricks like you around. Not surprising at all. The line judge was not assaulted so go vent your frustrations somewhere else.

Please stop saying it was an “accident.” It wasn’t an accident, It was an intentional act. We’re responsible for the consequences of our intentional acts.

That said, there’s been a heavy financial consequence for the act, and it seems to me that’s a fitting punishment. I don’t think he needs to be punished endlessly or banned. If it happened again, that would be time to consider a suspension.

The other thing I don’t understand is the “oh well, he was angry and frustrated.” That’s not an excuse for anything, is it? I mean in our lives when we’ve left childhood behind, are any of us allowed to excuse our behavior because we were angry? Can we kick the water cooler and break it because we’re angry? Do we get to throw things around the office because we’re angry and then it’s ok? I hope not. I wouldn’t care to work any where like that.

I suppose you can argue about it, but here are the elements of assault

Quote:
Three elements must be established in order to establish tortious assault: (1). the plaintiff apprehended immediate physical contact, (2). the plaintiff had reasonable apprehension (the requisite state of mind) and (3). the defendant's act of interference was intentional (the defendant intended the resulting apprehension). But intent for purposes of civil assault can be either general or specific. Specific intent means that when the defendant acted, he or she intended to cause apprehension of a harmful or unwanted contact. General intent means that the defendant knew with substantial certainty that the action would put someone in apprehension of a harmful or unwanted contact.
I was always taught that intending the act was enough to establish the general intent. But, you can go your own way.

Some people really are clueless with regard to the law . Why do you think there's the provision of intent? The law does not punish you equally if you did something unintentionally.

Taking away ALL the prize money and points he worked for and then charging him is TOO FREAKING MUCH. You can see in this incident and the reaction by some to it all that's wrong with this world when someone claims that this was assault when people are dying of hunger and povery in Africe but we chose to concentrate on such a non-event. Complete BS.

"Assault"? Oh please...

A decent enough lawyer can easily defend this bullsh!t "assault" charge. If all injuries caused by reckless behaviors lead to "assault charges" then I don't see the police having time for anything else.
