If I throw a bottle at a wall in frustration and someone inadvertently walks in front of it and is injured, I can't then claim it was their responsibility to look out for flying objects. In any situation, the law takes into account perceived risks. Had the linesman been injured by a ball in play, that would have been a perceived risk. If I walked onto a rugby field and was injured, that would have been a perceived risk. It is not contingent on a linesman or ballgirl or spectator to get out of the way of a tennis player acting violently. Your defense is a joke.

But that water incident was clearly another accident. It was not his intention to get that person wet. All he was doing was throwing water in their direction and they should have ducked for cover. It is always up to the would be victim to be on the alert at all times and take the necessary evasive actions when needed... Please stop digging up all these accidents. Nalby's never intended to cause trouble. He is a gentle soul.

The only reason he called out the ATP is because he didn't want to apologize and he wanted to make it seem as if he kicked the board simply to make a point.

I'm not sure how anyone can call an assault, "the slightest mistake" and it's not even as though this is the first time he has behaved badly either. I doubt the police will end up charging him but hopefully the threat of it happening will force him to finally grow up. He's been behaving like a spoiled brat for too long.

11 years on tour and the best examples of nalbandian being a Bad Person people can come up with are throwing some water, kicking a box and calling Henman a phony. lock up this menace now.
