First amendment absolutist? Meaning what?

Term referring to people who believe that when the Constitution says that "Congress shall make no law" that infringes upon the first amendment that they mean literally... no law. I'm alright with flag burning, pornography, obscenity, etc, etc, etc. There have been several Supreme Court justices in the past who have been first amendment absolutists and when a film came before them to judge on obscenity they wouldn't attend the screening because they thought there should be no limits on speech whatsoever and they already knew their decision on the case because of those convictions. I'm okay with violent video games, I'm okay with Janet Jackson's boob being flashed, so on and so on.

savesthedizzle
04-25-2006, 10:20 PM
Well I should say I'm not an absolute absolutist. I'm at about 90% because I do understand the need for some speech to be limited when it comes to national security, however the Bush administration is going a bit nuts with this. I think they're morons. They are reclassifying information that has been declassified for ages. Stuff from WWI era is suddenly being reclassified after its been available in public libraries for years. and they are declassifying almost nothing. Lots of information is just disappearing. Also against child pornography, but thats a different thing than speech I'd say, that's protecting children. :p

Haute
04-26-2006, 12:03 AM
To me, flag burning is a bit of a tricky situation. Not for the act itself, but for the precedence it could set for other symbolic acts. It's be like someone condoning the Oklahoma City bombings because McVeigh was displeased with the government. But I think you know what I mean.

And with pornography, the only thing is where it is displayed. Like regulations against advertising for a strip joint by a school are needed. A second grader doesn't need to go home and ask their parents, "Mommie, what's a lap dance?" :p

See my friend your pornograph thing is okay :) Speech can be regulated constitutionally only if it's content neutral and passes the time/place/manner test. You can change the time of speech, the place of speech and the manner of speech, but not the content. So you can say you can't advertise a strip joint by a school as long as they ARE allowed to advertise somewhere else.

As for flag burning and that type of speech that is different as well. That is an area of speech not covered by the Consitution and that is action. And words that promote action. McVeigh is breaking about a billion laws with Oklahoma City. It's not the content of his speech again, but the time, place and mainly the manner in which he carried it out. Flag burning you can't say the same thing about :)

I'm trying to think now about Supreme Court rulings, and I don't think there has really ever been one that says pornography is illegal (excluding child pornography, of course), but it's the timing and place that are under scrutiny. If it were illegal altogether, Hugh Hefner would have been out of a job and home a long time ago. :p

Flag burning isn't as clear cut, because it depends more on the opinions of the justices on the bench at the time. But as I was trying to say earlier, it's a bit like Griswold v. Connecticut in that you have to be careful in how you rule because that could set a precedence in another area that wasn't intended. Griswold v. Connecticut was decided mainly on the presumption that the 1st, 3rd, 4th, and 9th Amendments could be interpretted to create the right to privacy. And logically this could be applied to gay marriage and criminalization of homosexuality in some states as well, but it's all up to the Court to decide this. If there had been a more liberal Court for Bowers v. Hardwick, the right to privacy could have been extended to that case as well. So what I'm trying to say with flag burning is that it's about the precedence it would set. The Court wouldn't flat out say one way or another whether it's constitutional or not, but would have to specify whether it is being symbolic speech or not. I was using Oklahoma City as a bit of an extreme example, but say flag burning is allowed as being symbolic speech (and I think it is allowed by Texas v. Johnson, but that might have been reversed), but then you have to consider what other forms could be considered symbolic speech and you have to figure out where to draw the line. And sometimes if the Court isn't ready to establish where the line is, they rule against it until another case comes up where they might be able to settle the line.

Is this making sense at all? I totally dig Supreme Court cases and constitutionality. :D Obviously. :p

Well you see, pornography is legal, but obscenity is not. The difference is not entirely clear sometimes and magazines like Penthouse and Playboy HAVE been put on trial for obscenity and are generally not found guilty. I never said it was illegal, I was saying that as speech I say it's okay. Many would disagree with me. ;) Keep trying to think of court cases though and when you're stuck I'll give you the list of them I need to know for my final.

I feel very disturbed right now. The U of M stalker followed me today. :scared: He followed me all the way across campus. When I came out of the skywalk he was standing right there, like he was just waiting for someone to come along so that he could follow them. It was still early enough today that there weren't a whole up of people up there yet for their finals.

And no one has ever seen him to go any classes. The library staff has to have campus security walk them out to their cars at night because of him. He's never done anything more than that, so nothing can be done about him until he crosses the line and harms someone. Bah....

Jessita, I need to ask a question. Consider your answer carefully, because I may have to divorce you from this thread if it's the wrong answer. ;) Seriously...

What do you think of Michael Moore? Yay or nay?

Why am I watching this show now about plane crashes? lol I'm just thinking about it and realizing, how the hell does a plane get off the ground... there are too many things that can do wrong once it's up in the air...

Yet I love to fly. lol

OMG do not talk to me about planes crashing for the next 24 days please.

I DO. Because that's how many days there are until I am flying somewhere. My parents don't fly! They work! They are the proletariat! :p

So? I don't casually slip import substitution industrialization into a conversation now, do I? :p

Anyway, I had a horrible night. After about 5 or 6 am, I kept waking up having mini anxiety attacks. I don't know why, because these were the types that I usually get just before I go away on a trip. I don't consider going to U of M to drop of my final being a trip. lol

Do you have that all planned out? Like.. knowing what to do, where to go, what job you'll have, how you'll afford it, how it works, what paperwork you need done?

My dear. THAT is the fear of graduation. All of a sudden you need all that planned because you have no idea what you are going to do when you wake up the next morning.

So what are you going to do before that? Any plans? If you don't want to be freaked out when your graduation comes, you better figure this all out now. :p

I've known since about 8th grade that I want to be involved in politics, figured out in 10th or 11th grade that I wanted to do international, and it's been within the last year that I've figured out which region I want to be involved. Originally I thought about the Middle East, but that might have to be something to work up to... lol
