How come some people have avatars bigger than 96x96 but is not a premium member, is there anyway you can do this?

So if my avatar is 91x129 but only 3.15KB why should it get scaled down if it fits the 9.8KB rule? Your avatar needs to be both smaller than 96x96 and less than 9.8KB.
