Why not? I think the banning of a poster should be something we have a say in, not just a "mod decision and deal with it" kind of scenario.

It is not just a mod decision really. The rules section of the board has been up for about a month now and there have been no/few comments about it, which seems to mean that everyone agrees. Things like wishing death, trolling, forum disruptions, multiple accounts are against the rules. The rules were set, no one disagreed with them. Another rule that was included there was discriminatory remarks. No one disagreed with that one.
So the rules were set, posters agreed with them, or did not express their beliefs otherwise. Now they get enforced. This poster we are talking about managed to get three infractions for the same offense. Discriminatory remarks is one of the easiest things to identify. Johnny, has anyone discriminated against you? Did you have a hard time realizing it was discrimination? I bet you knew right away if you were ever in that situation.
I think there are times you can argue a ban, but with ones like discrimination, I think it is pretty black and white. Please let me know, however, if you feel differently or if you feel that discrimination should be allowed on MTF.
