I wonder to what extent the First Ammendment's protection of freedom of expression has contributed the irrational hyperbole that seems to be becoming more widespread in political discourse in the US.

Of course it has. I wouldn't trade free speech for a more pleasant discourse, though. That slope is very steep and very slippery. The last thing we need are politicians passing laws determining what is and isn't acceptable to say. How would you go about doing so?

I agree though I'm torn because I think it's more than merely a matter of discourse. The language used shapes attitudes and dumbs down the entire political culture. Why debate someone's policies when you can dismiss them without any sense of irony as a freedom-hating communist or whatever.

I have no idea what could be done to turn back the tide in that regard because a lot of the insults are too vague and far-fetched to even be considered defamatory. If there was to be a restriction on some of the language of the lunatic fringe it wouldn't necessarily require new law just a different interpretation of the existing laws in the courts. Obviously in a common law system judges are seriously restricted by precedent so it might be easier said than done.

I mean the US system is undoubtedly preferable to that of the UK where inverstigative journalism is made next to impossible by libel laws but the freedoms there have had some negative consequences as well.

Kagan is not qualified. Her credentials are 2 years of private law practice and a few years of clerking for judges. She has no experience as a judge or a litigator. She's not even a legal scholar - she has few publications. All she has going for her is academic pedigree and political connections with Obama. Being dean of HLS does not substitute for years or decades of experience as a judge, and there are frankly dozens of liberal and conservative candidates who are better qualified in that arena.

I think she's also stupid.

PD, your Jewish nationalism is transparent. It's as pathetic as my erstwhile knee jerk Serbian nationalistic support for that loser Djokovic. Actually worse, because tennis is irrelevant whereas a SCOTUS justice is important.

Indeed, as we are all cognizant of the superabundance of unintelligent individuals who have graduated from Harvard, Princeton, and Oxford. Never mind the little known fact that stupidity is a prerequisite in order to become dean of Harvard Law School, as well as a professor at the University of Chicago. Putting aside your vapid generalities and baseless assumptions, experience is a significant factor, yet the level of importance you ascribe to it is excessive. Experience can be acquired, whereas intelligence is fixed. In short, an intelligent person can acquire experience, but mere experience will not add IQ points.

Why can't she get experience on a lower court? Why take the risk? We still don't know very much about her. Her lack of legal experience and an associated paper trail won't help.

I see nothing intelligent, enlightened, fresh, or eloquent in this speech. It's redundant, trite, smug, and I really think she has a major speech impediment.

So let's see:

"PROS":

1.) Gay

3.) For PD, Jewish
4.) Academic pedigree
5.) Political connections

CONS:

1.) No judicial experience
2.) No strong litigation experience
3.) Sparse scholarly output
4.) Poor and unimaginative public speaker
5.) Hideous/mannish

Hmm, I'm sure there's absolutely no one better qualified for the position of Associate Justice than Elena Kagan...

I'm apt to extend a longer rope to those who are clearly gifted. Ms. Kagan is an innate thinker who possesses the tools, both intellectual and interpersonal, with which to influence her colleagues. A bit of tautology: some experience is preferable to none at all. In other words, I don't mind her inexperience. Other than a few Republicans who must appease their parochial constituents, few others will mind it. Still, dignified Republicans will find it difficult to oppose someone who embodies moderation. Kagan is, in many ways, reflective of the future of the United States: tolerant of social liberty and economic prosperity.
